2. Eligibility

You must be at least 13 years old to use Smooth Operator. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

The Service is intended for personal development and practice purposes only. It is not a substitute for professional advice, therapy, or counselling. The AI-generated responses and feedback should not be relied upon for making important life decisions.

4. Subscription and Payment
4.1 Free Tier
Smooth Operator offers a free tier with limited features and usage. Free users may have restrictions on the number of conversations or features available.
4.2 Premium Subscription
For unlimited access to all features, you may subscribe to our premium service on a monthly or annual basis. Subscription pricing is displayed in the app at the time of purchase.
4.3 Billing
Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selection). Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date.
4.4 Payment Processing
All payments are processed through the Apple App Store or Google Play Store, depending on your device. You agree to comply with their respective terms of service for purchases.
4.5 Cancellation
You may cancel your subscription at any time through your device's app store settings (Apple App Store or Google Play Store). Cancellation will take effect at the end of your current billing period, and you will continue to have access to premium features until then.
4.6 Refunds
Refunds are handled by Apple or Google according to their respective refund policies. To request a refund, please contact Apple App Store Support or Google Play Support directly.
4.7 Price Changes
We reserve the right to change subscription prices. Any price changes will apply to billing periods starting after the change and will not affect your current subscription period. We will provide reasonable notice of any price increases.
5. Acceptable Use
5.1 Permitted Use
You may use Smooth Operator for personal, non-commercial purposes to practice and improve your conversation skills.
5.2 Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Attempt to extract, manipulate, or reverse engineer the AI systems
- Use the Service to generate harmful, abusive, threatening, or harassing content
- Impersonate any person or entity or misrepresent your affiliation
- Share your account credentials with others or allow others to use your account
- Attempt to bypass any usage limitations or access restrictions
- Use automated systems, bots, or scripts to access the Service
- Interfere with or disrupt the Service or servers/networks connected to it
- Upload or transmit viruses, malware, or other malicious code
- Use the Service to practice or prepare for illegal activities
6. User Content
6.1 Your Content
You retain ownership of any content you create or submit through the Service, including text messages and voice recordings ("User Content").
6.2 Licence Grant
By using the Service, you grant us a worldwide, non-exclusive, royalty-free licence to use, process, store, and transmit your User Content solely for the purposes of:

You are solely responsible for your User Content. You represent and warrant that your User Content does not violate any applicable laws or these Terms.
7. Artificial Intelligence and Third-Party Services
7.1 AI-Generated Content
The Service uses artificial intelligence, including technology provided by OpenAI, to generate responses and feedback. You acknowledge that:
- AI-generated content may not always be accurate, appropriate, or suitable for your specific situation
- AI responses should not be relied upon as professional advice
- We do not guarantee the accuracy, completeness, or reliability of AI-generated content
7.2 Third-Party Services
The Service relies on third-party services including OpenAI for AI processing and Google Firebase for infrastructure. Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the availability, performance, or policies of third-party services.
8. Intellectual Property

The Service, including its design, features, functionality, and content (excluding User Content), is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR AUD $100, WHICHEVER IS GREATER
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Smooth Operator and any affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

- Your violation of these Terms
- Your violation of any rights of another party
- Your User Content
12. Termination
12.1 Termination by You
You may terminate your account at any time by deleting your account through the app settings or by contacting us at hello@smoothoperator.app.
12.2 Termination by Us
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms.
12.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
13. Changes to Terms
We may modify these Terms at any time. If we make material changes, we will notify you by:
- Posting the updated Terms in the app
- Updating the "Effective Date" at the top of this page
- Sending you an email notification for significant changes
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
14. Governing Law and Disputes
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
14.2 Dispute Resolution
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiations. If the dispute cannot be resolved through negotiations within 30 days, either party may pursue resolution through the courts of New South Wales, Australia.
14.3 Class Action Waiver
To the extent permitted by law, you agree that any disputes will be resolved on an individual basis and you waive any right to participate in a class action lawsuit or class-wide arbitration.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
15.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15.3 Waiver
Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or our right to enforce it later.
15.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
15.5 Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labour, or materials.
